A husband and wife passing through Habersham County from Florida were arrested Thursday on drug charges after a DUI stop by Habersham County Sheriff’s Deputies.
Around 3:30 p.m. March 30, deputies investigated a car at a traffic stop on Highway 365 near Alto-Mud Creek Road that allegedly had the odor of marijuana coming from the vehicle, according to the sheriff’s incident report.
Wilbert Brian Berrios, 55, of Palm Coast, Fla., was driving and told the deputies he has a medical marijuana card issued by the state of Florida. He advised them that he smoked weed around two hours earlier and that he and his wife were headed to the Smoky Mountains for vacation.
Deputies put Wilbert through multiple field sobriety tests and determined that he was allegedly driving under the influence. They moved on to search the car, where Wilbert’s wife Theresa Marie Berrios, 56, also of Palm Coast, Fla., was waiting.
Theresa initially refused to step out of the vehicle, the deputies said, but later agreed to do so. Deputies searched and found multiple drugs in the front seat, including five tramadol pills, three broken tramadol pills, one unknown tablet and suspected cocaine. The deputies also found in a bag six glass smoking devices which had marijuana, a white powder substance, a black substance and crushed pills inside of them. There also was an open container of alcohol inside the vehicle.
The deputies told Theresa she was being arrested, and she “began to actively and physically resist arrest pushing her body against the arresting officers and seemingly attempting to get away.” The deputies, with help from Alto Police, subdued Theresa and placed her in the patrol car.
In the trunk of the vehicle, there was a bag located with several white containers inside. Each of these containers had “! THC” on them. Each container contained suspected THC gummies (60 in total). There were also three large THC oil containers filled with oil, one of which was almost like a syringe, the report said.
While entering jail, Theresa was discovered to have a white capsule “with more suspected cocaine inside of it in her groin area.”
Theresa was arrested on charges of crossing guard lines with weapon/drugs/intoxicants, possession of drug related objects, possession of a controlled substance (three counts), possession of cocaine, obstruction of an officer and possession of marijuana.
Wilbert was arrested on charges of possession of drug related objects, possession of a controlled substance, possession of cocaine, illegal possession of controlled substance (two counts), DUI, possession less than one ounce of marijuana.
