NOTICE OF SALE UNDER POWER
Because of a default under the terms of the Security Deed executed by Gregory D. Christian to Mortgage Electronic Registration Systems, Inc., as grantee, as nominee for Primelending, A Plainscapital Company, its successors and assigns dated December 11, 2017, and recorded in Deed Book 1154, Page 966, Habersham County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, N.A. securing a Note in the original principal amount of $194,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, March 3, 2020, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that tract or parcel of land lying and being In Land Lot No. 173 of the 10th Land District of Habersham County, Georgia, and more fully described as follows: Lot Nos. 9X, 10, 11, 12 and 13 according to plat of Skyline Subdivision of Cornelia, Georgia, made by John F. Carey for Cornelia Bank, a copy of which is on record in the Clerk's Office, Habersham County, Georgia, in Plat Book 6, pages 172-173, said plat being made on July 12, 1956, and revised as to Lot No. 9 on December 5, 1958, The entire lots are described as follows: Beginning at a point with the Bomar Olds Lot No 9 on Arroyo Terrace (or Valley Road); and running thence along the old Lot No. 9 North 60 degrees 41 minutes West 126.91 feet to corner common to Lots 8, 9, 9X, 10 and 11; thence running with Lot No. 8 North 84 degrees 30 minutes West 133.77 feet to Tower Terrace; thence North 7 degrees 48 minutes East 109.89 feet to corner of Lot No-12; thence North 7 degrees 52 minutes East 115.23 feet to corner of Lot No. 15; thence along Lot No. 15 South 82 degrees 38 minutes East 144.78 feet to corner with Lot No. 14; thence along Lot No. 14 South 89 degrees 43 minutes East 109.25 feet to a corner on the Arroyo Terrace Street; thence along the said Arroyo Terrace South 10 degrees 11 minutes East 124.73 feet to a corner; and thence South 13 degrees 20 minutes West 110.86 feet to a corner; thence South 34 degrees 57 minutes West 43.32 feet to Beginning corner. LESS AND EXCEPT: All that tract or parcel of land lying and being in Land Lot 173 of the 10th Land District of Habersham County, Georgia, designated as Lot 11A on plat of survey made by Catherine P. Olds by Hubert Lovell, Registered Surveyor; under date of July 2,1986, a copy of said plat being of record in the Office of the Clerk of Superior Court of Habersham County, Georgia, in Plat Book 23, Page 30, to which said plat and the record thereof reference is hereby made for a more complete description. This being that same property conveyed to Joyce A, Jordan and H. Robert Jordan via Warranty Deed with Remainder to Survivor from Sandra B. Butterworth dated March 25, 1994, recorded in Deed Book 316, Page 301 of the afore written deed records.
Said property is known as 129 Arbutus Trail, Cornelia, GA 30531, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of Gregory D. Christian, successor in interest or tenant(s).
